Summary
Sun Zhigang, then working in Guangzhou, was taken into custody on March 17, 2003, transferred through custody-and-repatriation and treatment facilities, and died on March 20. Nanfang Metropolis Daily brought his experience to public attention on April 25. Contemporary judicial reporting records first-instance and final decisions in June in the intentional-injury case and separate dereliction proceedings. New State Council assistance measures took effect on August 1, repealing the earlier custody-and-repatriation measures.[1][3][6][4]
Description
On March 17, 2003, Sun was taken to a police station from Huangcun Street, Guangzhou. Nanfang Metropolis Daily reported that he had an identity card but was not carrying it and lacked a temporary residence permit. Colleagues unsuccessfully sought his release. He was transferred to a custody-and-repatriation transit station the next day and to a treatment facility that evening.[1]
After his death on March 20, relatives sought an explanation and forensic examination. An April 25 investigation cited findings issued on April 18 and questioned the initial explanation. June court reporting records a finding of fatal traumatic shock from extensive soft-tissue injuries caused by beatings.[1][2][3]
June 9 court reporting records sentences for twelve intentional-injury defendants, including death for Qiao Yanqin and death with a two-year reprieve for Li Haiying. Six personnel were sentenced separately for dereliction of duty. Xinhua reported on June 27 that Guangdong High Court upheld the injury-case sentences and Qiao was executed.[2][3][6]
The case prompted public discussion of custody-and-repatriation regulations. Xu Zhiyong recalls sending a review proposal with Yu Jiang and Teng Biao on May 14. CECC’s report also records scholars’ proposals for regulatory review and a special investigation by the NPC Standing Committee.[7][5]
The State Council adopted new assistance measures on June 18 and promulgated them on June 20. Article 18 provides for commencement on August 1 and simultaneous repeal of the 1982 custody-and-repatriation measures. The new rules define temporary social assistance and prohibit detention, disguised detention and abuse of recipients.[4]
Developments
Taken to a police station
Contemporary reporting says Sun was taken to Huangcun police station without his identity card on him and without a temporary residence permit. This does not mean he lacked an identity card.[1]
Transferred through custody and treatment facilities
Contemporary reporting describes transfer to the custody-and-repatriation transit station and then to a treatment facility that evening.[1]
Death
Investigation published
Sina reproduced Nanfang Metropolis Daily’s investigation, presenting colleague and family accounts and reported forensic findings.[1]
Joint constitutional-review recommendation mailed, according to Xu
In The Last Ten Years, Xu recalls mailing a recommendation with Yu Jiang and Teng Biao on May 14 seeking constitutional review of custody-and-repatriation rules. This is a participant’s later recollection, not the original petition or an official review decision.[7]
First-instance decisions reported
CCTV reported first-instance sentences for twelve defendants in the intentional-injury case and separate dereliction-of-duty sentences for six others. Original decisions and later rulings have not been obtained.[3]
State Council promulgates new assistance measures
State Council Order No. 381 promulgated new assistance measures; promulgation and commencement are distinct dates.[4]
Final appeals and execution reported
A contemporary reproduction of Xinhua’s June 27 dispatch reports that Guangdong’s High People’s Court rejected the twelve intentional-injury defendants’ appeals and upheld the sentences; Qiao Yanqin was executed. Five separate dereliction appeals were rejected, while Zhang Yaohui had not appealed. Original trial, appellate and execution documents remain unavailable.[6]
